
Discrimination in Austria - Relevant?
Yes, unfortunately it does.
According to a study conducted by the Vienna Chamber of Labor in 2019, 44 per cent stated that they had been discriminated against at least once in the last three years.
It should be noted that the Equal Treatment Act does not provide comprehensive protection against discrimination to people outside of their employment. Outside of employment, people are only protected against unequal treatment on the basis of sex and ethnicity, which encompasses protection against harassment and sexual harassment. In contrast, in addition to protection against unequal treatment on the basis of sex and ethnicity, employees also enjoy protection against discrimination on the grounds of sexual orientation, age, religion or belief. With regard to unequal treatment due to disability, the Equal Treatment Act only contains procedural provisions. The bases for claims in such cases are derived from the Disability Employment Act (BEinstG) for employees and from the Federal Disability Equality Act (BGStG)) for "everyday life".
Unfortunately, many of those affected refrain from taking action against discrimination (a quarter to a third ). Therefore the number of unreported cases is likely to be much higher. Such failure in reporting unequal treatment might be due to a lack of knowledge about which actions are actually prohibited by law as well as due to ignorance about the possibilities to take action against it.

Discrimination in Austria - Relevant?
The Equal Treatment Act comprehensibly protects individuals at their work place, covering discrimination against sex, age, ethnicity, religion or belief and sexual orientation. It does not protect against perceived social standing, family status and does not include individuals with disabilities. Instead, individuals with disabilities have two acts Disability Employment Act (BEinstG) and the Federal Disability Equality Act (BGStG)) at their disposition, which provide extensive protection.

This module aims at raising your awareness for what amounts to discriminatory as well as (sexually) harassing behavior and to provide you with information that will help you in your everyday life, especially as an employee.

- What rights do those affected have and who provides help?
The knowledge you will have gained, will enable you to reflect on your own actions and help yourself, your company and others in case you or someone else is ever discriminated against.
